In occasione del Safety Day Symposium, svoltosi il 9 Novembre 2011 a Senago, avevo presentato un contributo relativo alle nuove norme che regolano l'immissione sul mercato cinese di chemicals ricevendo come feedback un tiepido interessamento da parte di solo alcune aziende.

Con il 1° Dicembre 2011 è terminato il periodo di implementazione delle nuove norme e la piena efficacia delle "Regulations on Safe Management of Hazardous Chemicals in China" (Decree 591 - 2011) determina l'applicazione di sanzioni pecuniarie (da 50.000 a 100.000 RMB) da parte delle Autorità cinesi alle aziende che infrangono le disposizioni concernenti la classificazione e/o l'etichettatura delle sostanze e miscele pericolose.

Ricordo inoltre che tutte le sostanze esportate in Cina e non incluse nell'inventario IECSC 2010 (Inventory of Existing Chemical Substances in China 2010) sono da considerarsi sostanze "nuove" e, indipendentemente dalla quantità, devono essere notificate al Chemical Registration Center (CRC) del Ministry of Environmental Protection (MEP). In particolare segnalo che le circa 14.500 esenzioni per le sostanze rilasciate secondo la norma precedente alle "Measures of Environmental Administration of New Chemical Substances" (Order No. 7 - 2010) sono scadute e che le aziende interessate devono notificare le stesse secondo le disposizioni del c.d. China REACH.

A tale proposito, a fronte delle crescenti richieste giunte nelle ultime settimane, Flashpoint ha messo a punto un servizio di "CHINA HELP DESK" per offrire un servizio gratuito di "assistenza preliminare" alle imprese che esportano in Cina. At the Safety Day Symposium held on November 9th, 2011 in Senago (Milan), I presented a paper on the new regulations that would come into effect regarding the submission of chemicals into the Chinese market. The result was a lukewarm reception from a few companies only.

The implementation phase of these new regulations ended on the 1st of December 2011 and now the full effect of the "Regulations on Safe Management of Hazardous Chemicals in China" (Decree 591-2011) determines that financial penalties (from 50,000 to 100,000 RMB ) will be filed by Chinese authorities against any company that violates the provisions regarding the classification and / or labelling of substances and mixtures.

Any substances exported to China that are not included in the IECSC 2010 (Inventory of Existing Chemical Substances in China 2010) will be deemed as "new" substances and, regardless of quantity, must be brought to the attention of the Chemical Registration Center (CRC) of the Ministry of Environmental Protection (MEP). In particular, may I point out that about 14,500 exemptions for substances released according to the regulation prior to "Measures of Environmental Administration of New Chemical Substances" (Order No. 7 - 2010) have expired and must be notified by in accordance with the provisions of the so-called China REACH.
